OBJECTIVE These Terms and Conditions (hereinafter, "T&Cs") apply to this platform owned by KUDZU PERU SAC – KUDZU SAC (hereinafter, the "COMPANY" or "KUDZU"), domiciled at Av. El Polo No. 401, Unit 408 (4th Floor), Santiago de Surco district, Lima province, Peru. By accessing and browsing the online platform https://www.bekudzu.com/ (hereinafter, the "Platform"), the user (hereinafter, the "User" or "Users," as applicable) acknowledges having read, understood, and accepted the COMPANY's website terms and conditions of use without restrictions, reservations, or modifications. Accessing and using the Platform in any manner implies the User's acceptance of and familiarity with the T&Cs, which are mandatory and binding. GENERAL TERMS AND CONDITIONS A "Customer" is defined as any person registered on the Platform who has authorized the COMPANY to store their data for the purpose of contact regarding the delivery and/or sale of products or services, as well as the dissemination of information and promotions from the COMPANY. By conducting any transaction on the Platform, the Customer acknowledges and accepts these T&Cs. Accordingly, the Customer is deemed to fully agree to the COMPANY's T&Cs without the need for any further confirmation. To continue visiting and using the Platform's services, the User declares that they are of legal age and possess the necessary legal capacity to be bound by these T&Cs; individuals lacking such capacity, those who are disqualified or suspended, and minors may not access the services. Parents, guardians, or those responsible for minors using the Platform shall be liable for such use, including any charges, billing, or damages arising therefrom. The COMPANY commits to making its best efforts to provide full and continuous access to and use of the Platform. However, should any failure or interruption of the Platform occur due to fortuitous events, force majeure, or technical issues, the COMPANY shall not be held liable, nor shall it be held responsible for any damages or losses incurred, provided the cause of the event is not directly and demonstrably attributable to the COMPANY. SPECIFIC TERMS AND CONDITIONS Transactions carried out on the Platform are subject to these Terms and Conditions, as well as—on a supplementary basis—the applicable laws of the country of origin. Accordingly, the User and/or Client is required to—and hereby agrees to—review and accept these Terms and Conditions prior to using the Platform’s services or making any purchase. SERVICE DESCRIPTION The Platform is a virtual platform where various products and their specifications are displayed. Through the Platform, the Client may purchase any of the displayed products and have them delivered to the address specified by the Client. The COMPANY offers jewelry through its Platform. Before making a purchase via the Platform, the User and/or Client should be aware that selected products may be out of stock or otherwise unavailable. All purchases are subject to availability. Once the Customer makes a purchase via the Platform and the COMPANY verifies that the corresponding payment has been deposited into the COMPANY’s accounts, the order will be prepared and subsequently dispatched to the Customer under the conditions agreed upon in this document. Orders will be dispatched within 2 to 5 days for shipments within Metropolitan Lima and within 4 to 7 days for shipments to the provinces, calculated from the time the purchase confirmation is sent to the Customer. The Customer and/or User may request to pick up the purchased products at their own risk and discretion, subject to prior coordination with the COMPANY. Should any event, unforeseeable circumstance, or force majeure occur that makes it impossible to ship the order within the specified timeframe, the COMPANY will inform the Customer of such circumstances; under no circumstances shall these constitute grounds for cancelling the order or modifying the purchase terms, unless previously discussed and agreed to by the COMPANY. If the Customer and/or User no longer wishes to proceed with the purchase due to force majeure or unforeseeable circumstances, they may request cancellation of the order, subject to prior coordination with the COMPANY.
